The data processing is carried out on the basis of a service contract between the Publisher and tetraeder.

Browser software data

The Internet is a global area of electronic communication. Standardised protocols have been developed to make this available to all devices connected to the Internet. A protocol in the information technology context manages the electronic communication between the computers involved and is responsible, among other things, for the security of this communication. In addition, your browser software transmits various information about this and the operating system of the device you are using. The following incomplete list should give you an idea of the information transmitted:

A part of this data is stored on tetraeder’s servers for logging tetraeder’s Services. This data is stored in so-called log files and analysed for statistical purposes. The log files also serve to protect tetraeder’s servers from unauthorised access and manipulation, as well as deletion or entry of data. The log files will be deleted from tetraeder’s servers after 30 days.

Collection and processing of personal data and its purpose

Personal data is any information about your identity such as your name, your e-mail address, your IP address or your postal address in connection with your name.

IP addresses represent technical personal data. When you visit the tetraeder Service, the IP address is transmitted and processed. IP addresses are required to transmit data to you. Furthermore, tetraeder uses IP addresses to protect its own Services against possible unauthorised use and to generate statistics.

Other data that is processed, which is not personal data, includes information and settings of the browser used or the screen resolution of the device.

Use and transfer of personal data in general

A transmission of data to third parties does not take place, unless this is based on a contract, consent or tetraeder’s obligations in relation to the performance of service orders. Another basis for this would be the order by a court to disclose the data. Tetraeder’s affiliated companies pursuant to Section 15 of the German Stock Corporation Act (AktG) are not to be considered as third parties within the scope of this privacy statement.

Opting out of advertising

Data security and storage

tetraeder takes precautions to protect your personal data from loss, destruction, falsification, manipulation and unauthorised access. tetraeder complies with the data protection laws of the Federal Republic of Germany.

Transmission of data via the Internet

By using the Service provided here or by communicating with tetraeder via electronic contact forms, you agree to the non-encrypted transmission of all data. Due to the inherent structure and modus operati of the Internet, there may be intermediate steps contained in the transmission of data. The initiated data transmission is performed at your own risk, unless tetraeder offers you an encrypted transmission path. tetraeder will always try to offer this transmission path and use current technologies to secure the transmission of data in the best possible way.

The web pages of this Service may contain cross references (so-called links) to other services within and outside of tetraeder. This privacy statement does not apply to these links. Please obtain information separately about the privacy statement of the respective links. Use of the Services by children

tetraeder strongly advises all parents and guardians to teach their children the safe and responsible handling of personal data on the Internet. Children should not transmit any personal data to tetraeder’s website without the consent of their parents or guardians. tetraeder will not knowingly collect personal data from children, use it in any way, or disclose it to third parties without authorisation. tetraeder gives parents the right to obtain information about personal data collected from their children, unless the children have full legal capacity. Cooperation with providers of server infrastructure

To ensure the availability of tetraeder Services, tetraeder cooperates with a provider for server infrastructure, Hetzner Online GmbH. Hetzner Online GmbH, based in Industriestr. 25, 91710, Gunzenhausen, Germany, has concluded a service agreement with tetraeder for the storage and processing of data from tetraeder’s business activities. The data is protected against loss, misuse and unauthorised access, transfer, modification or deletion. tetraeder logs access, collects access passwords and encrypts data, as long as this does not fundamentally affect tetraeder’s Services.

Your rights under the GDPR

As far as your personal data is processed by tetraeder, you are the data subject under the GDPR. The following rights arise from this for you:

Right to information

You are entitled to know whether and how tetraeder processes and uses your personal data. In addition, you may request information regarding the following:

  • For what purposes tetraeder processes the data
  • Which data is processed
  • To whom the data is disclosed
  • How long the data is stored
  • The existence of the right to have your personal data deleted or corrected
  • The existence of the right of appeal to a regulatory authority
  • Information about the origin of the data, if the personal data was not collected from you
  • The existence of automated decision making, including profiling, in accordance with Article 22 (1) and (4) GDPR and, in these cases, meaningful information on the logic involved and the scope, and intended impact of such processing on the data subjects

Right to correction

If your personal data is not correct, you have the right to ask tetraeder to correct this data.

Right to restrict processing

You may request the restriction of the processing of your personal data under the following circumstances:

  • If you dispute the accuracy of your personal data for a period of time that allows tetraeder to verify it
  • If the processing is not lawful and you do not request deletion, but only a restriction of use
  • If tetraeder no longer needs the respective data for processing purposes, but uses them for the assertion, exercise or defence of legal claims
  • If you have filed an objection to the processing (see right of objection below) but it is not yet clear whether tetraeder’s legitimate interests outweigh your interests

If the processing of your personal data is restricted, such data may be processed only with your consent or for the purpose of asserting, exercising or defending legal claims, protecting the rights of another individual or entity, or for reasons of major public interest of the European Union or a Member State.

Right to deletion (right to be forgotten)

If any of the following reasons apply to you, you have the right to request tetraeder to delete your personal data immediately:

  • The relevant data is no longer necessary for the purposes for which it was processed
  • You revoke your consent, on which the processing under the GDPR is based, or there is no legal basis for the processing of the data
  • There are no legitimate reasons of overriding importance for the processing of the data or you object to the processing of the data
  • Your personal data was processed unlawfully
  • The deletion of the data is a legal obligation under German law or to the law of the European Union
  • Your personal data has been collected in relation to information society services offered in accordance with Article 8(1) of the GDPR

If your data has been published, the information about the deletion of your data must also be passed on to third parties involved. You also have the right to be informed of these bodies.

However, there are exceptional circumstances where the right to have personal data deleted does not apply. Circumstances that supersede this right are given when the data:

  • Serves to exercise the right to freedom of expression and information
  • Is needed to meet a legal obligation in the public interest or to exercise official authority conferred on tetraeder
  • Is in the public interest for the purposes of archiving, scientific or historical research, statistics or public health

Right to data portability

You can request personal data provided by you from tetraeder at any time. tetraeder must then transmit the data to you in a structured, standard and machine-readable format. You also have the right to transfer this data to another responsible person without tetraeder preventing you, as long as this procedure is consensual or based on a contract, and is carried out by means of automated processes.

To the extent technically feasible, you may request, in exercising your right to data portability, that tetraeder transfers personal data directly to another responsible person. Exercising this right does not affect the right to be forgotten. The right to data portability does not apply to data processing necessary for the performance of a task assigned to tetraeder, in the public interest or to exercise of official authority.

Right to object

You have the right to object at any time to the processing of personal data concerning you. tetraeder will no longer processes personal data unless compelling legitimate reasons apply that preclude your right to object. A further reason for refusing an objection may be the assertion, exercise or defence of legal claims.

If your personal data is used for direct marketing purposes, you have the right to object to this type of processing. This also applies to profiling, insofar as it is related to direct marketing. If you object to this use of your personal data, it will no longer be processed for these purposes.

Right to withdraw consent under data protection law

You have the right to withdraw your consent under data protection law at any time. The lawfulness of your data’s processing that has taken place up to the withdrawal remains unaffected.

Online data collection through associated services

Web analysis

A web analysis of the Service provided here will take place. This ensures the provision of tetraeder’s Service and prevents misuse of our services. During this process, the data and protocols of the web server are analysed and treated accordingly. This applies, in particular, to an extremely high rate of requests from an IP address and the respective blocking of Internet services that are not provided. tetraeder uses specially programmed tools and derives statistics for this purpose. The processing is based on the provision and safeguarding of the tetraeder Service (Art. 6 (1) sentence 1 lit. f GDPR).

Use of user memory

Due to the browser software and the Internet’s general modus operandi and implementation, data from the tetraeder Service will be stored on your system. This is generally referred to as cache memory and enables the rapid availability of certain data, especially image tiles for map depictions or larger image files. Please note that it is possible to deactivate this in the browser software. For further information please use the help function of your browser software.

The data stored on your system is still subject to the copyright of the respective owner. You are therefore not entitled to use, store or process the data commercially without the permission of tetraeder or any other respective author.

Use of short URLs

tetraeder uses its own service for short URLs (so-called URL shortener). This service is represented by the web address tet4.de. Links with this domain are subject to the same privacy statement as this Service provided here.

Use of JQuery

This Service uses the programming library jQuery der JS Foundation (https://js.foundation). This library is provided via the server infrastructure of the company JS Foundation. Loading the programming library for the tetraeder Service transmits the IP address to a server of JS Foundation. This is necessary to ensure the provision of the Service. For efficiency reasons, the programming library is cached by your browser software for a certain time. This means that you do not always transmit your IP address to the servers of JS Foundation.

To the extent possible under licensing law, tetraeder provides programming libraries via its own server infrastructure.

Use of Leaflet

This Service uses the programming library Leaflet by Vladimir Agafonkin (http://leafletjs.com). This library is provided via the server infrastructure of the company Leaflet. Loading the programming library for the tetraeder Service transmits the IP address to a server of Leaflet. This is necessary to ensure the provision of the Service. For efficiency reasons, the programming library is cached by your browser software for a certain time. This means that you do not always transmit your IP address to the servers of Leaflet.

To the extent possible under licensing law, tetraeder provides programming libraries via its own server infrastructure.

Use of OpenLayers

This Service uses the programming library OpenLayers by OpenLayers Dev Team (http://openlayers.org). This library is provided via the server infrastructure of the company OpenLayers. Loading the programming library for the tetraeder Service transmits the IP address to a server of OpenLayers. This is necessary to ensure the provision of the Service. For efficiency reasons, the programming library is cached by your browser software for a certain time. This means that you do not always transmit your IP address to the servers of Leaflet.

To the extent possible under licensing law, tetraeder provides programming libraries via its own server infrastructure.

Use of OpenStreetMap

This tetraeder Service uses the open source mapping tool OpenStreetMap ("OSM") to display geodata. In order for the map to be displayed, your IP address is forwarded to OpenStreetMap. Special Notices Associated with the Service

Cadastre for solar potential

Database

The database of the land registry for solar potential or green roof potential comprises of laser scan data, address data, building surrounds and aerial photo data. This data contains no personal reference and is provided by the Publisher. Further information on the data used and the licence can be found in the legal notice of this Service.

Search function within the map depiction

With the search function, it is possible to search for addresses or a building identification key that refers to an address. For this purpose a connection to the tetraeder server is established. Hence, there is a connection between your IP address, which is defined as personal data, and the search query. By entering your own address and connecting the IP address, it is possible to establish a personal reference in case of possible court orders.

It is possible that you inadvertently send personal data to tetraeder by entering it. The search queries will be deleted from our servers after 30 days.

Wizard for calculating the economic efficiency of a solar system

General notes on the wizard

By using the wizard (hereinafter referred to as "Wizard") to calculate the economic efficiency of a solar system, a connection to the tetraeder servers is established. The first time the Wizard is accessed, it creates the default configuration in the tetraeder databases and then overwrites it if the user makes changes. The stored data includes all possible entries and values that are not personal. The IP address will not be stored. The server log files will be deleted after 30 days. The entries and log files are stored in separate systems. The URL is generated randomly and has no reference to the IP address.

Purpose of saving the entries in the Wizard

By saving the entries, the user is able to recall and adjust the configuration. Furthermore, it is possible to divide the configuration of a bank or craftsman and to adapt it if necessary. The user has the option to share his/her configuration with other users via the URL of his/her configuration without possible extensions of the Wizard by social media buttons. Furthermore, the storing of data serves the provision of the solar roof exchange. This product by tetraeder allows other users to view systems that have already been configured and to contact the owner of a building.

Deletion of entries in the Wizard

The data will be deleted by tetraeder after 2 years. The time frame of 2 years allows a user to perform all necessary steps to set up a solar system within this time and to access the configuration at all times. tetraeder gives users the right to request a deletion through the URL. All you have to do is send the URL via informal e-mail to datenschutz@tetraeder.com. Even after the deletion, it is possible that the URL will be created and accessible again, but this is only possible with the default values or a different configuration than the configuration existing prior to the deletion.
